Canada-US tax residency checker

Answer the questions below. The result is a likely outcome only, based on the CRA residential ties approach and the IRS substantial presence test. Cross-border cases need review, and I prepare both Canadian and US returns.

Days in each country

Ties to Canada

US status and ties

Treaty tie-breaker hints (used only if you may be resident in both)

How it works

  • Canada: a home, spouse or partner, or dependants in Canada are significant residential ties. Without them, 183 or more days can make you a deemed resident.
  • US: citizens and green card holders are US residents for tax. Others are tested on days: at least 31 this year and 183 weighted days (this year, plus one third of last year, plus one sixth of the year before).
  • If both countries could treat you as resident, the treaty tie-breaker looks at permanent home, then centre of vital interests, then habitual abode, then citizenship.
